Wake Up to the Wonder of Art prize draw terms and conditions

1. The prize draw

1.1 The promoter is the Board of Trustees of the National Gallery, a body established under section 1(1) of the Museums and Galleries Act 1992 whose address is the National Gallery, Trafalgar Square, London WC2N 5DN (“NG”).

1.2 The title of the prize draw is “Wake Up to the Wonder of Art”.

1.3 The prize draw is free to enter and the winner will be selected at random from valid entries received by NG.

2. The prize

2.1 The prize is:

2.1.1 the opportunity to spend the night in a bed in the National Gallery on 9th May 2025;

2.1.2 Dinner and Breakfast at the National Gallery; and

2.1.3 a private tour of the National Gallery by a curator.

2.2 The prize commences at 7.30pm on Friday 9th May 2025 with dinner, the winner’s bed shall be set up at 9pm, after the last visitors leave the NG’s premises.

2.3 NG reserves the right to replace the prize with an alternative prize of equal or higher value if, for whatever reason, the original prize is not available.

2.4 The prize is not transferable, exchangeable or negotiable. There is no cash alternative to the prize.

3. How to enter

3.1 The prize draw will run from 9am on 7th April 2025 (the “Opening Time”) to 6pm on 27th April 2025 (the “Closing Time”) inclusive.

3.2 All entries must be received by NG by no later than the Closing Time. All entries received after the Closing Time are automatically disqualified.

3.3 To enter the prize draw, you must have:

3.3.1 subscribed to the National’s Gallery’s newsletter or be an existing subscriber to the National Gallery’s newsletter;

3.3.2 provide accurate contact details as part of your sign-up to the terms; and

3.3.3 comply with the eligibility criteria below.

3.4 No purchase is necessary.

3.5 NG does not accept responsibility for entries that are lost, mislaid, damaged or delayed, regardless of cause, including (for example) as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind

3.6 By entering the prize draw, you agree to be bound by these terms and conditions.

4. Eligibility

4.1 The prize draw is open to persons aged 18 years or over, except:

4.1.1 employees, trustees, contractors and workers of NG or its group companies;

4.1.2 anybody who is professionally connected with the prize draw or its administration; or

4.1.3 members of the immediate families or households of anyone in (a) and (b) above.

4.2 Entrants agree and acknowledge that acceptance of the prize and announcement of the winner is subject to:

4.2.1 entrants meeting the NG’s security requirements (see paragraph 5.3);

4.2.2 entrants accepting the prize within the prescribed timeline (see paragraph 6);

4.2.3 entrants are responsible for ensuring that they are able available and able to attend the NG’s premises to receive the prize at the times and dates required (see paragraph 3); and

4.2.4 entrants agreeing to take part in such publicity of the prize as the Gallery requires (see paragraph 7)

4.3 By entering the prize draw, you confirm that you are eligible to do so and to claim any prize that you win. NG may require you to prove that you are eligible to enter the prize draw.

4.4 NG will not accept entries that are:

4.4.1 automatically generated by computer, bot or other AI-resource of any type;

4.4.2 completed by third parties or in bulk;

4.4.3 illegible, have been altered, reconstructed, forged or tampered with; or

4.4.4 incomplete.

4.5 There is a limit of one entry to the prize draw per person. Entries on behalf of another person and joint entries are not allowed.

4.6 You may unsubscribe at any time, however, if you unsubscribe before the Closing Time your entry may be voided by the NG.

4.7 NG may disqualify you if your conduct is contrary to these terms and conditions or to the spirit or intention of the prize draw.

5. Winner

5.1 NG’s decision is final and no correspondence or discussion will be entered into.

5.2 NG will contact the winner as soon as reasonably practicable after the Closing Time by using the email address provided with the competition entry.

5.3 Any entrant successful in the draw will be subject to a Baseline Personnel Security Standard (BPSS) check (or any such equivalent required by NG), prior to any announcement of a winner by the NG. By entering into the prize draw you acknowledge and agree that you will provide the information required to undertake this test as soon as practicable following the draw. If you do not provide such information in accordance with such timelines as the Gallery requires, your entry may (at the Gallery’s absolute discretion) be deemed ineligible and withdrawn by the Gallery.

5.4 NG must make available information that indicates that a valid prize award took place. To comply with this obligation, NG will send the surname and county/country of prize winner to anyone who emails marketing@nationalgallery.org.uk within one month after the Closing Time. If you object to your surname, county or winning entry being made available, please contact marketing@nationalgallery.org.uk. In such circumstances, NG must still provide the information to the Advertising Standards Authority on request.

6. Claiming the prize

6.1 To claim the prize, the winner must confirm receipt of the email from the National Gallery informing them that they have won the prize and respond confirming that they wish to receive the prize within 1 week of the original notification. If you do not claim the prize by this date, your claim will become invalid.

6.2 The prize may not be claimed by someone else on your behalf.

6.3 NG will make reasonable efforts to contact the winner. If the winner cannot be contacted or is not available or has not claimed their prize by the timeframe set out in paragraph 6.1 above, NG may offer the prize to the next eligible entrant selected from the valid entries that were received before the Closing Time.

6.4 NG does not accept any responsibility if you are not able to take up the prize or do not respond to NG’s attempts to contact you within the time limit.

7. Publicity

7.1 You agree to participate in a reasonable amount of publicity on NG’s behalf. This will include publishing your name and photograph in any media and may include that the winner shall:

7.1.1 be filmed and photographed by the NG and such images may be used by NG in its social media and shared with third party media outlets in connection with the promotion of the NG and its charitable purposes;

7.1.2 take part in such interviews and media appearances as the NG reasonably requires; and

7.1.3 acknowledge that their name, fame and image may be used by the NG in connection with the promotion of the NG, the prize draw and the in connection with the charitable purposes of the NG; and

7.1.4 be filmed, photographed and interviewed by any press associated with NG and such images and may be used by press outlets across their channels including television, audio, print and digital.

7.2 The winner of the competition acknowledges that as part of their enjoyment of the prize their personal data may be captured on the Gallery’s CCTV cameras.

7.3 Competition entrants agree that their personal data may be used as described in paragraphs 7.1 and 7.2 on the lawful basis of their entry into these prize draw terms and conditions.

8. Data protection

8.1 NG will only process your personal information of entrants to the prize draw in as set out in its privacy policy and to announce winner as described in paragraph 5.4 above.

9. Limitation of liability

As far as permitted by law, NG, its agents and distributors are not in any circumstances liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize, except where this is caused by the negligence of NG, its agents or distributors or that of its employees. Your statutory rights are not affected.

10. General

10.1 If NG believes that you have breached these terms and conditions, NG may (at its sole discretion) exclude you from participating in the prize draw.

10.2 NG may void, suspend, cancel or amend the prize draw if it becomes necessary to do so.

10.3 These terms and conditions are governed by English law. All entrants to the prize draw submit to the exclusive jurisdiction of the courts of England and Wales.
